ClubReq Terms & Conditions

Introduction
Welcome to ClubReq (the "Service"). Using the Service, you agree to comply with and be bound by the following terms and conditions (the "Terms"). These Terms apply to all users, including customers (employers), role expert interviewers, and applicants. Please review these Terms carefully. If you disagree with any part of these Terms, you should not use the Service.
Use of Service (All Users)
Eligibility
You must be 18 years or older to use the Service.
Account Registration
You agree to provide accurate, current, and complete information when registering for an account and to update such information as necessary to maintain its accuracy.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. ClubReq will not be liable for any loss or damage arising from your failure to safeguard your account details.
Service Access and Restrictions
You agree to use the Service only for lawful purposes and in compliance with these Terms. Unauthorized use of the Service is prohibited.
License to Use the Service
ClubReq grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purposes, subject to these Terms. You agree not to use the Service for any unlawful purpose or in any manner inconsistent with these Terms.
Subscription Model and Pricing (Customers/Employers)
Subscription platform Access
ClubReq provides a subscription-based model for accessing its platform, which includes AI-powered candidate screening and other essential services. Subscription pricing and terms will be detailed in a separate agreement. You may cancel your subscription at any time, and no additional charges will incur thereafter cancellations.
Optional Role Expert Interviewers
As an additional feature, customers (employers) have the option to add an extra layer of vetting candidates through role expert interviewers. This service is available as an in-app/platform purchase on a pay-per-screen basis. Role expert interviewers are independent contractors, not employees of ClubReq.

Confidentiality
All interview data, recordings, and applicant information are treated confidentially and are used solely for the hiring process.
Data Retention
Interview recordings and associated data will be stored securely for up to two years. After this period, the data may be securely deleted. You may request access to or deletion of your data, subject to legal obligations.
Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you agree to the terms of the Privacy Policy.
Limitation of Liability
To the maximum extent permitted by law, ClubReq and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
(a) Your use or inability to use the Service;
(b) Unauthorized access to or use of your account or content; or
(c) Any other matter relating to the Service.
Modification of Terms
ClubReq reserves the right to modify these Terms at any time. If any changes are made, we will provide notice through the Service or by other means. Continued use of the Service after the notice period will constitute your acceptance of the revised terms.
Termination of Use
ClubReq reserves the right to suspend or terminate your access to the Service at any time, without notice, for conduct that ClubReq believes violates these Terms, is harmful to other users, or is otherwise inappropriate.
Intellectual Property Rights
All content, trademarks, logos, and software related to ClubReq are the intellectual property of ClubReq and are protected by applicable laws. You agree not to copy, modify, distribute, or reverse engineer any part of the Service without ClubReq’s prior written consent.
Indemnification
You agree to indemnify and hold harmless ClubReq, its affiliates, and their respective officers, employees, and agents from any claims, damages, liabilities, losses, or expenses arising from your use of the Service or your violation of these Terms.
Third-Party Services
The Service may include links or integrations with third-party services. ClubReq is not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by the terms and conditions of the third party.
Force Majeure
ClubReq shall not be liable for any failure to perform due to causes beyond its reasonable control, including, but not limited to, acts of God, war, strikes, or government actions.
Dispute Resolution and Governing Law
Arbitration Clause
Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By agreeing to these Terms, you waive your right to bring disputes to court including the right to a jury trial.
Governing LawThese Terms are governed by and construed in accordance with the laws of the state of your residence or where the Service is primarily used.
Agreement to Receive Text Messages
By providing your mobile number, you agree that ClubReq may send you SMS or MMS messages related to job opportunities, interview scheduling, application updates, and other relevant information.
- You may receive up to 7 messages per role you are being considered for. The total number of messages you receive may vary depending on how many roles you apply for or are matched with.
- You may unsubscribe at any time by texting the word STOP to [insert sending number here]. You may receive a confirmation message following your opt-out request.

- Message and data rates may apply.
- United States participating carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile, and others.
- T-Mobile is not liable for delayed or undelivered messages.
- You agree to notify us of any changes to your mobile number and to update your account accordingly.
- Data collected may include your cell phone number, your carrier's name, the content and timing of messages, and other information you provide. We use this information solely to deliver and support the messaging service.
- By subscribing or otherwise using the service, you acknowledge and agree that we may change or discontinue the service at any time, with or without notice.

Will I be charged for the messages I receive?
ClubReq does not charge you for receiving text messages. However, message and data rates may apply depending on your mobile service plan. Please contact your wireless provider if you have any questions about your text or data plan.
Acknowledgment and Acceptance
By using ClubReq’s services, you acknowledge that you have read, understood, and agree to these Terms. If you disagree with any of the terms, you must refrain from using the Service. Continued use of the Service signifies your acceptance of any changes, including updates to pricing and services.
